THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.38437 of 2016 ORDER :

This writ petition is filed apprehending that the respondentMunicipality is trying to demolish the properties of the petitioners and markings are also made.

Learned counsel for the petitioners alleges that no prior notice or opportunity was afforded and due process is not followed before steps are taken to demolish the properties of the petitioners and that the properties of the petitioners are private owned properties, the same cannot be removed/demolished without following due process.

Learned Standing counsel representing the Municipality, on instructions, submits that a survey was conducted to identify the future requirements of the Municipality and in the process of conducting survey, markings were made. As of now, no steps are being initiated to demolish the properties and the respondentCorporation would follow due process before effecting the private properties.

Having regard to the said statement of learned standing counsel, no further orders are required in this writ petition. 5.

Writ Petition is accordingly, disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
