THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25809 of 2017 ORDER:

This writ petition filed under Article 226 of the Constitution of India challenges the tender notification, dated 15.07.2017, issued by the 2nd respondent calling tenders for grant of license for operations and maintenance of public convenience facilities located at NTR gardens, Buddha Purnima Project Area, Hyderabad, for three years.

Heard the learned counsel for the petitioner and the learned Standing counsel for the 2nd respondent, Sri V.Narasimha Goud. The only ground urged in the writ petition is that the petitioner has no knowledge about the notification issued by the 2nd respondent, as the 2nd respondent got the said notification published only in Namasthe Telangana daily newspaper. It is the settled and well established principle of law that unless there is involvement of public interest, violation of any statute and patent arbitrariness, jurisdiction of this Court under Article 226 of the Constitution of India is not available so far as the contractual matters are concerned. In the absence of any such contingencies and since the petitioner failed to demonstrate involvement of the same, this Court is not inclined to entertain the present writ petition.

The writ petition is therefore dismissed. No costs. Miscellaneous petitions, if any, shall also stand dismissed. __________________ A.V.SESHA SAI, J Date: 03.08.2017 ES
