THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4330 of 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to release the vehicle bearing No. TS 07 AE 5116 seized in connection with crime No.51 of 2016 on the file of the P.S., Moinabad, Cyberabad, Ranga Reddy District, registered for the offence under Section 34(A) of the Andhra Pradesh Excise Act.

Heard and perused the material.

Learned counsel for the petitioner submits that if the vehicle is kept idle, it would get damaged and as such, prays this Court to release the vehicle.

Considering the facts and circumstances of the case, this Court is not inclined to give any direction to release the vehicle. The petitioner is directed to file an application before the Court below for release of the vehicle and the Court below is directed to dispose of the said application in accordance with law.
