THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 15697 OF 2017 O R D E R :

Heard learned counsel for the petitioners and Sri N. Ashok Kumar, learned Standing Counsel for the Corporation. The petitioner challenges the notice dated 01.04.2017 issued by the 3rd respondent under Sections 452(1) and 461(1) of the Hyderabad Municipal Corporation Act, 1955 whereby it was alleged that they had made the unauthorized construction of cellar + stilt floor in premises bearing No. 19-4-285 situated at Mir Alum Filter, Khaja Phadi, Tadbun, Hyderabad and hence, to show cause as to why the said constructions should not be pulled down. From the affidavit filed in support of the Writ Petition, it is not clear as to whether the petitioner constructed ground + four floors or ground + one floor.

However, inasmuch as the petitioners were given the notice, they shall submit their explanation within ten days from the date of receipt of a copy of this order. On receipt of such explanation, the respondent authorities shall consider and pass necessary orders thereon in accordance with law. Till such time the final orders are passed, no coercive steps shall be taken against the petitioners.

The Writ Petition is accordingly, disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
