THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10105 of 2015 ORDER:
This Criminal Petition is filed by the petitioners - A2 to A5, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.128 of 2015 on the file of Mallapur Police Station, Karimnagar District, registered for the offences punishable under Sections 498-A IPC and 3 & 4 of the Dowry Prohibition Act. Heard and perused the material available on record. The marriage between A1 and the de facto complainant was performed four years back. Out of wedlock, they blessed with a female child. Petitioners are the parents and sisters-in-law and brother-in-law of A1. The allegation against the petitioners is that they all harassed the de facto complainant for demand of additional dowry.
Since the present complaint arises out of matrimonial dispute, this Court is of the view that arrest of the petitioners would cause prejudice in case of future settlement between the parties. Therefore, this Court is inclined to grant anticipatory bail to the petitioners.
In the circumstances, the petitioners - A2 to A5 are directed to surrender before the Magistrate concerned on or before 21.10.2015 and on such surrender, they shall be released on bail on their executing personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the petitioners are directed to appear before the Station House Officer concerned, as and when required.
