HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 33859 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in trying to dispossess the petitioners from their agriculture land with standing crop " Jamail Trees" and " Maize" crop, to an extent of Ac.2.00 in Sy.No.1708, Ac.3.00 in Sy.No.787 and Ac.1.00 in Sy.No.757 situated at Thimmapalem Village, Ponnalur Mandal, Prakasham District by issuing notice Rc.Dt/ 230/ 2017, dated 13.09.2017 is illegal, arbitrary and violative of principles of natural justice. 2) Learned counsel for the petitioners would submit that though the notice under Section 7 of the Land Encroachment Act was issued on 13.09.2017, the same was served on the petitioners on 14.09.2018, which is strongly disputed by the learned Government Pleader for Revenue, but no material is available as to when it was served.

3) As the case of the petitioners being that notice was served on 14.09.2018, the petitioners shall submit their explanation within a week from today, in which event, the concerned authority shall pass appropriate orders, in accordance with law, if no orders are already passed till date

to a notice issued under Section 7 of the Andhra Pradesh Land Encroachment Act.

4) With the above direction, the Writ Petition is disposed of at the admission stage. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _________________________ JUSTICE C. PRAVEEN KUMAR 19.09.2018 gkv
