THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.37030 of 2015 ORDER:
The prayer of the petitioners in this case is as under: "For the reasons stated in the accompanying affidavit the petitioners herein pray that this Hon'ble Court may be pleased to issue a Writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent 3 and 4 in harassing the petitioners by calling them to police station and confining them to illegal detention at the behest of Respondents 5 to 8 as illegal and arbitrary, unconstitutional, violative of rights of citizens envisaged under the articles of Constitution of India and consequently direct the Respondents 3 to 4 to not to interfere with the legal activities of the petitioners by calling them to police station and to pass such other orders as this Hon'ble Court may deem fit and proper in the circumstances of case, in the interest of justice."
The Inspector of Police, Keesara Police Station, Cyberabad Commissionerate, filed a counter-affidavit stating that upon the complaint made by the 5th respondent, an enquiry was caused into the contents thereof by the police authorities. However, instead of cooperating with the enquiry, the petitioners are stated to have approached this Court and obtained an interim order. It may be noticed that the interim order passed by this Court on 16.11.2015 merely required the police authorities to follow the prescribed procedure and not unduly interfere with the petitioners' life and liberty. That being so, the writ petition is disposed of directing the police authorities to strictly abide by the procedure prescribed under the Code of Criminal Procedure, 1973, in the event the petitioners' examination/interrogation is warranted in the context of any criminal investigation.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
