THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.774 of 2016 ORDER:

This Criminal Petition is filed by the petitioner under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in an unregistered crime.

Heard and perused the material available on record. It is stated that one Nitesh Beriwal, who is the Executive Director of the complainant's-company mismanaged the funds and accounts of the company and as the petitioner was working in the above company at that time, the complainant's company is making all false allegations against the petitioner. Therefore, the petitioner apprehends arrest.

Learned Public Prosecutor submitted that no crime was registered against the petitioner.

Considering the above submission made by the learned Public Prosecutor, this Court is not inclined to grant the relief prayed by the petitioner. However, the respondent-police concerned are directed to issue notice under Section 41-A Cr.P.C. to the petitioner, if any case is registered against him.
