ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 and A2 seeking to quash the proceedings in C.C.No.191 of 2015 on the file of the Judicial First Class Magistrate, Bodhan, for the offences punishable under Sections 406, 409, 420, 468 read with Section 34 IPC, against them.

2. It is alleged in the charge sheet that during the course of audit of PACS Bhavanipet for the year 2002-2003, it is found that an amount of Rs.13,17,952/- was misappropriated by the then President, Secretary and Salesman i.e., A1 to A3. Based on the complaint given by the Divisional Cooperative Officer, Bodhan, a case in Cr.No.169 of 2015 of Bodhan Police Station, Nizamabad, was registered against the accused for the offences punishable under Sections 406, 409, 420 read with Section 34 IPC.

3. In view of the allegations mentioned in the charge sheet, the matter has to be decided after full fledged trial and therefore, this Court is not inclined to interfere with the impugned proceedings. However, the presence of the petitioners/A1 and A2 before the trial Court is dispensed with except on the dates whenever their presence is insisted by the trial Court and they shall be represented by their counsel.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
