HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.20889 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondents in dissolving/removing the managing committee of the 7th respondent society having committed the misappropriation of funds including not recovering of amount nearly Rs.83,93,150.00 as being illegal, arbitrary, unjust and violation of its Rules and the Co-operative Societies Act, 1964 and consequently to direct the respondent Nos.1 to 6 herein forth with remove the managing committee of the 7th respondent society and recover its misappropriation amount nearly tune of Rs.83,93,150,00 by implementing notices issued by the 5th respondent herein i.e. notices its 1st notice Rc No.785/2015-B, dt.15.10.2015, 2nd notice Rc. No.785/2015, dt.20.11.2015 and 3rd notice Rc.No.785/2015, dated 09.12.2015.

2. Heard the learned counsel for the petitioner, learned counsel for 7th respondent and learned Government Pleaders for Co-operation and Revenue.

3. The relief sought by the petitioner is to direct the respondents to complete the enquiry against the 7th respondent society. Learned Government Pleader for Co-operation, on instructions, submitted that the enquiry was completed long back and surcharge proceedings were issued on 10.6.2016 by the Deputy Registrar of Co-operative Societies, Miryalaguda. Learned counsel for the 7th respondent filed copy of the surcharge proceedings dated 10.6.2016. In view of the submission made by the learned Government Pleader for Cooperation, no further orders are required to be passed in this writ petition.

3. Accordingly, the writ petition is closed. Miscellaneous petitions, if
