HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1509 of 2015 ORDER:
This revision is preferred challenging the docket order dated 23-06-2015 made in C.C. No.26 of 2015 by the Additional Judicial Magistrate of First Class at Nidadavolu, wherein the learned Magistrate issued N.B.Ws. against petitioners/accused while dismissing the petition filed by the petitioners invoking the provisions under Section 317 Cr.P.C.
The learned counsel for the petitioners submitted before this Court that petitioners are ready to face the trial and they will not flee from the hands of justice. Having heard the learned counsel on either side and perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :
The petitioners/accused are directed to surrender before the Court concerned and file a petition to recall the warrants issued against them and on such filing of a petition, the trial Court is directed to recall the warrants on the same day on their execution of bond for a sum of
Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and further the petitioners are directed to appear before the trial Court regularly. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
