THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33797 OF 2018 ORDER :
When the matter is taken up, written instructions, dated 24.09.2018, furnished by the Station House Officer, Vijayawada Police Station, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under:
"It is submitted that as per the orders of the Joint Collector,-II, Krishna & RDO, Vijayawada and as requested by the 6th respondent, Ajith Singh Nagar Police enquired the matter with the petitioner herein. The petitioner was also asked to obey the orders issued by the Joint Collector-II, Krishna & RDO, Vijayawada.
On that, the petitioner informed the Ajith Singh Nagar Police that he would approach the Joint Collector-II and after that he will take a decision and report the same. It is submitted that, on 31.8.2018 the petitioner came to the police station and informed that he handed over the house to his father i.e.
6th respondent herein. On 4.9.2018 the 6th respondent came to the police station and informed that, he again hand over the house keys to his son upon his son's request that his wife was carrying 6 months pregnancy and that he would re-deliver possession of the house to him after his wife gives birth to a child. The 6th respondent further stated that he has
handed over the house keys to his son in the presence of the Administrative Officer of Joint Collector-II & RDO Office, Visakhapatnam.
It is submitted that, thereafter the 6th respondent has not approached the police station. The police have also not called the petitioner to the police station".
By placing on record the above written instructions, Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ A.V.SESHA SAI, J 23rd October, 2018 Tsy
