HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.30573 of 2016 Order:

This Writ Petition was filed challenging the action of the respondents 5 to 7 in not implementing the Government Policy i.e., "The Public Procurement Policy for Micro and Small Enterprises (MSEs) Order 2012, as illegal and arbitrary and consequently to direct the respondents 5 to 7 to consider the online bid dated 05.09.2016 submitted by the petitioner for construction of Office Block of Laboratory Building-4 at BARC Main Campus Site, Atchutapuram, Visakhapatnam district. When the matter is taken up for consideration, it is submitted by the learned counsel for the petitioner that nothing survives for adjudication in the Writ Petition and the matter has become infructuous. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
