HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.13933 OF 2016 ORDER:
The present petitioners are requesting to quash the proceedings in D.V.C. No.25 of 2016 who are arraigned as respondent Nos.2 and 3 which D.V.C. was pending on the file of the IV Metropolitan Magistrate - cum - Protection of Women from Domestic Violence (Act 2005), Erramanzil, Hyderabad.
2. Heard. There are prima facie allegations occurring in the complaint against the petitioners herein.
3. Learned counsel for the petitioners would submit that even the Calendar Case in C.C. No.148 of 2013 is pending before the learned Judicial Magistrate of First Class, Armoor, in which, the petitioners are also accused and even attending.
4. Learned Public Prosecutor would represent that the presence can be dispensed with as sought for by the learned counsel for the petitioners.
5. Since the petitioners have been attending the Court of Judicial Magistrate of First Class mentioned above, to the extent of their presence before D.V.C. No.25 of 2016 on the file of the IV Metropolitan Magistrate - cum - Protection of Women from Domestic Violence (Act 2005), Erramanzil, Hyderabad, is dispensed
with, but however, subject to condition that they shall appear before the said Court whenever their presence is directed by the said Court.
6. Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in the criminal petition, stand closed.
