HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 3 9 2 2 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Deputy Superintendent of Police, Ananthapuram Sub-Division, Ananthapuramu, dated 16.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that a case was registered in Cr.No.29/ 2018 for the offences under Sections 420, 406 and 120(B) r/ w 34 I.P.C., and Sections 3 and 4 of the A.P.Gaming Act against the writ petitioner and 19 others registered by the Sub-Inspector of Police, Ananthapuram I-Town P.S. In the above, the writ petitioner is arrested and others are yet to be arrersted. The investigation is pending and some more witnesses are to be examined.
It is submitted that another case in Cr.No.73/ 2018 was registered against the writ petitioner and others for the offence under Section 110(e) Cr.P.C.,, and the writ petitioner and others by the Sub-Inspector of Police, Ananthapuramu I-Town P.S., and the writ petitioner and others were produced before the Mandal Revenue Officer, Ananthapuram, for bindover of the respondents. It is submitted further that on a special report from the Inspector of Police, Ananthapuramu ITown, the Sub-Divisional Police Officer, Ananthapuramu opened Suspect Sheet No.653/ AN against the writ petitioner and the same was transferred to Ananthapuramu III Town P.S., on 10.08.2018 vide C.No.49/ BC.SDPO.A/ 2018, dated 10.08.2018, since the writ petitioner is residing
within the jurisdiction of Ananthapuramu III Town P.S. limits.
It is submitted that the Police I-Town P.S.
never entered into the house of the writ petitioner and never threatened the family members of the writ petitioner and the writ petitioner filed the present Writ Petition with baseless allegations.
The writ petitioner filed the present Writ Petition to escape from the criminal proceedings. It is submitted that the writ petitioner did not approach the Hon'ble High Court with clean hands. Hence, the Writ Petition is devoid of merits and liable to be dismissed."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Deputy Superintendent of Police, Ananthapuram Sub-Division, Ananthapuramu, dated 16.11.2018.
