HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17893 OF 2017 ORDER:

This writ petition is filed by the petitioner seeking a direction to the respondents to extend the lease period for a further period of one year i.e., from 16th June, 2017 to 15th June, 2018 in respect of the land admeasuring Ac.5.43 cents in Sy.No.113/1 situated in Bodawada Mandagunta Village of Parchur Mandal, Prakasam District.

It is the case of the petitioner that the above land belonged to Mutyalakunta Cheruvu and the said land is endowed for the purpose of a tank. The tank was managed by the Hereditary Trustees belonging to the founder member family. The said land was put to auction for a period of three years. The petitioner was the highest bidder in the auction held on 17.6.2013 for lease hold rights over the above land. While so, Parchur Mandal was declared as drought affected Mandal. The petitioner suffered loss due to insufficient rainfall and with great difficulty, he paid the lease amount. As the petitioner is not having any other land, he gave a representation to the founder trustee for extension of lease for a period of one year commencing from June, 2017 to June, 2018. But the respondents have not passed any orders therein. The Endowment Department is trying to take steps to auction the lease hold rights over the subject land. Hence, the petitioner filed this writ petition.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The petitioner is directed to make a representation before the respondents concerned for extension of lease period for a period of one year in respect of the land in question. On such representation being made, the respondents concerned are directed to extend the lease for a period of one year." 5.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous petitions pending, if any, shall stand closed. _________________ JUSTICE RAJA ELANGO Dated: 6th June, 2017 Nn.
