THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33837 OF 2018 ORDER :

When the matter is taken up, written instructions, dated 20.09.2018, furnished by the Sub Inspector of Police Attili Police Station, West Godavari District, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under: "It is submitted that as per the station records, the respondent No.4 Station House Officer, Attili police station, West Godavari District received the petitioner's complaint through registered post on 17.09.2018, wherein he stated that the village elder Dasam Sriramalakshmana Satyanarayana Murthy @ Babli, called the villagers to conduct a meeting on 6.9.2018 at Ramalayam temple and the petitioner also attended the meeting and the petitioner asked the accounts of the said Temple, thereon the said Dasam Sriramalakshmana Satyanarayana Murthy threatened the petitioner not to ask the said account.

Subsequently on 7.9.2018 the said Dasam Sriramalakshmana Satyanarayana Murthy threatened the petitioner.

It is submitted that pursuant to the said complaint, the 4th respondent enquired into the matter and revealed that the contents of the complaint was non cognizable in nature. It is submitted that the 4th respondent made a requisition on

17.09.2018 to the Hon'ble II Addl.Judicial Magistrate of First Class, Tanuku to accord permission to register FIR. After obtaining permission from the Court, necessary action will be taken. In this connection entry was made into the General Diary on 17.09.2018.

It is submitted that the contention of the petitioner that respondent No.4 Station House Officer, Attili Police Station, West Godavari District not taken any action on the complaint of the petitioner is incorrect and baseless. It is submitted that the 4th respondent received the petitioner's complaint through registered post, as the contents of the complaint was non cognizable in nature, hence, the 4th respondent made a requisition to the Court and after obtaining permission necessary action will be taken on his complaint".

By placing on record the above written instructions, Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. __________________ A.V.SESHA SAI, J 23rd October, 2018 Tsy
