HON'BLE SMT. JUSTICE LALITHA KANNEGANTI WRIT PETITION No.45844 of 2022 O R D E R:

This writ petition is filed seeking the following relief: " ... to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the Respondent Nos.2 to 6 in failing to initiate action to stop the ongoing illegal Constructions being made by the 7th Respondent in Sy.No.655 admeasuring 520.72 Sq. Yards at House Number 3‐59 situated at Rampallydayara Village, Keesara Mandal, Medchal‐Malkajgiri District in spite of issuing the Notice of Intimation by the 6th Respondent vide its Proceedings GPRD No.12/2022, Dt.25‐10‐2022 to the 7th Respondent whereby refused to grant Building Permission as per the Resolution of the 6th Respondent Grampanchayat Dt.01‐10‐2022 under intimation to the 4th Respondent Dt.

07‐10‐2022 and still allowing the illegal Constructions to proceed by the 7th Respondent as illegal, arbitrary, un Constitutional and contrary to the provisions of T.S. Panchayat Raj Act, 2018 and consequently direct the Respondents 2 to 6 to forthwith stop the ongoing illegal construction being made by the 7th Respondent in Sy.No.655 admeasuring 520.72 Sq. Yards at House Number 3‐59 situated at Rampallydayara Village, Keesara Mandal, Medchal‐Malkajgiri District and to demolish the existing illegal constructions..." 2.

Sri C.Hari Preeth, learned counsel for the petitioner, submits that the petitioner, being Up-Sarpanch, has made a representation stating that the unofficial respondent, who is having certain civil disputes and pending between several persons, is going ahead with the construction and the official respondents failed to take any action on the said unauthorized construction.

The relief that is sought by the petitioner in the writ petition is in the larger public interest.

Accordingly, the writ petition is disposed of giving liberty to the petitioner to file Public Interest Litigation. No order as to costs. Miscellaneous applications, pending if any, shall stand closed. __________________________ LALITHA KANNEGANTI, J December 23, 2022 mar
