THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No. 33060 of 2014 ORDER:

Vide the present petition, the petitioners seek direction thereby directing the respondents to pay ex-gratia compensation for their lands acquired under Land Acquisition Act.

Heard learned counsel for the petitioners, learned G.P. for Land Acquisition and learned G.P. for Irrigation & Command Area Development.

It is stated in the writ affidavit that the petitioners are agriculturists and legal heirs of their predecessors who were assigned different extents of lands in different survey numbers of Ayyagaripeta Village, Sattupalli Mandal, Khammam District, and that the State Government has also issued assignment pattas in favour of their predecessors. It is further stated that the respondents have acquired their lands by initiating land acquisition proceedings vide G.O.Rt.No.841, dated 17.07.1990 under the Land Acquisition Act, for the purpose of constructing Bethupalli Flood Flow Canal (NTR Canal), but no ex-gratia compensation is paid to them till date. 4.

Learned counsel for the petitioners submits that the petitioners have represented to the authorities on 30.08.2004 seeking ex-gratia compensation for their lands, however, the petitioners neither received ex-gratia compensation nor any communication from the respondents.

Admittedly, after submitting representation to the respondents on 30.08.2004, the petitioners have neither pursued the matter further with the respondents nor approached the Court. 6.

However, in view of the submissions made, I deem it appropriate to dispose of the writ petition by granting liberty to the petitioners to make a representation to the respondents within four weeks from the date of receipt of a copy of this order. The respondents shall dispose of the representation, in accordance with law, within four weeks from the date of receiving of representation, and communicate the decision to the petitioners, in writing, within one week thereafter. If the petitioners are aggrieved with the decision taken on their representation, they are at liberty to approach appropriate forum, in accordance with law.
