THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1785 OF 2016 ORDER:
The petitioner/accused has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 30.03.2016 passed in Crl.M.P.No.4671 of 2015 in C.C.No.1866 of 2013 on the file of the II ACCJcum-XIX Metropolitan Magistrate, Cyberabad, Kukatpally, at Miyapur, whereby the learned Judge dismissed the petition filed by the petitioner/accused seeking discharge from the proceedings initiated against him. Heard and perused the material available on record. After arguing for some time, learned counsel for the petitioner confined his arguments with regard to dispensing with the presence of the petitioner before the Court below.
Considering the nature of allegations and also as the question of identity of the petitioner/accused does not arise, the presence of the petitioner/accused before the Court below is dispensed with except on the dates when the Court below insists for his appearance. The petitioner/accused is permitted to represent his case through the counsel before the Court below. The Criminal Revision Case is accordingly disposed of.
