The subject matter of the writ petition is an extent of 233 sq.yards covered by Door No.10-18 located in R.S.No. 444 of Vatluru village and Gram Panchayat, Pedapadu Mandal, West Godavari district.
2. The grievance of petitioners is that the third respondent is not entertaining the document presented by petitioners for registration on the ground that the Door number as well as survey number is covered by classification of land as Gramakantam.
3. The learned Government Pleader submits that the writ petition is filed without cause of action.
4. The petitioners apprehend refusal to receive document by the third respondent. The reason as is evident from the writ affidavit is that the subject matter is classified as Gramakantam.
5. The third respondent is under obligation to receive the document presented for registration, consider the same in accordance with the Act and pass appropriate orders. This court in a series of writ petitions has considered the right of Government to exclude Gramakantam in prohibitory list and refusal to registration on that ground prima facie is untenable. The petitioners are given liberty to present the document for registration and the third respondent is directed to receive the document, consider registration, having regard to the view expressed by this Court in WP.No.1339 of 2014 and batch dated 06/03/2014.
5. The writ petition is ordered as indicated above. No order as to costs.
6. As a sequel, Miscellaneous Petitions if any, pending in this writ petition shall stand closed.
