The grievance of the petitioner was that the police authorities were not taking action upon her complaint dated 08.07.2010 addressed to the Sub-Inspector of Police, I Town Law & Order Police Station, Kakinada.

The Sub-Inspector of Police, I Town Police Station, Kakinada, furnished written instructions dated 17.06.2015 to the office of the learned Government Pleader for Home, wherein he stated that the complaint dated 08.07.2010 allegedly made by the petitioner was never received in the police station. According to him, the petitioner never approached the police authorities and therefore the question of any inaction on their part did not arise.

Faced with this situation, Sri Prasad Babu, learned counsel representing Smt. D. Lalitha Prasad, learned counsel for the petitioner, states that liberty may be given to the petitioner to approach the police authorities by making a fresh complaint. He pointed out that the petitioner was aged over 80 years and that the police authorities may be directed to take suitable action in the matter.

In the light of the afore-stated facts, the writ petition is disposed of permitting the petitioner to approach the 2nd respondent by way of a fresh complaint, if her grievance still persists. In the event such a complaint is made, the police authorities shall duly consider the same and take appropriate action in the matter in accordance with law, if warranted.
