THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE DR. JUSTICE SHAMEEM AKTHER WRIT PETITION No.8014 OF 2017 ORDER: (Oral) (Per Hon'ble Sri Justice SURESH KUMAR KAIT) Vide the present petition, the petitioner has assailed the order dated 31.01.2017 passed in O.A No.4355 of 2016.

2. We note that the petitioner was kept under suspension by the first respondent by way of G.O.Rt No.442, Health, Medical and Family Welfare (VC-1) Department, dated 26.10.2016, on the ground that he was tampering of practical marks on OMR sheet in the subject of Practice of Medicine at the college. Six months have already elapsed. Since then, the petitioner is under suspension.

3. After some arguments, learned counsel appearing on behalf of the petitioner seeks permission of this Court to withdraw the present writ petition with liberty to file a representation to the Department to revoke the suspension pending enquiry against the petitioner.

4. Permission is granted.

5. Accordingly, the Writ Petition is dismissed as withdrawn with liberty as prayed for. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
