HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39240 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a direction to the 3rd respondent to provide necessary police help for implementation of interim orders passed by the IX Additional Chief Judge, C.C.C, Hyderabad in O.P.No.2228 of 2016. 2.
Heard and perused the material available on record. 3.
It is stated in the affidavit that the petitioner filed OP against the 4th respondent and obtained the order of status quo in respect of the property in question. On coming to know about the same, the 4th respondent along with his henchmen forcibly trespassed into the property of the petitioner, caught hold of his collar, threatened him and abused him in filthy language. Then, the petitioner approached respondent No.3 on 13.10.2016 and requested to register a case against the 4th respondent. The 3rd respondent received the complaint but refused to give any acknowledgement. 4.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
"Respondent No.3 is directed to register the complaint of the petitioner, if it discloses any cognizable offence and proceed in accordance with law. If the 3rd respondent fails to register the complaint, the petitioner is at liberty to approach the higher officials or to avail the remedies that are available under Cr.P.C." There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
