THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2715 OF 2017 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), requesting to quash the First Information Report in Crime No.20 of 2017 of Vetapalem Police Station, Prakasam District.

The petitioner is accused No.1 in the aforesaid crime. He alleged to have committed the offence punishable under Section 420 read with 34 of IPC.

Sri V.Sai Kumar on behalf of Sri T.V.S.Prabhakar Rao, learned counsel for the petitioner, would urge to give a direction to the Investigating Officer to follow the procedure under Section 41A of the Code.

The request of the learned counsel for petitioner appears to be reasonable, in view of the statutory mandate itself. Therefore, acceding to the said request, the Investigating Officer is directed to follow the procedure inlaid by the provisions of Section 41A of the Code and also the guidelines laid down by the Hon'ble Supreme Court in Arnesh Kumar v. State of Bihar1.

With the above direction, the Criminal Petition is disposed of at the stage of admission itself.
