THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22791 OF 2017 O R D E R:

This Writ Petition is filed seeking a mandamus to declare the inaction on the part of Respondents 2 to 4 against Respondents 5 to 9 based on F.I.R. No. 115 of 2017 dated 10.06.2017 of Korutla Police Station, despite the representation dated 20.06.2017 of the petitioner, as illegal and arbitrary.

A counter-affidavit has been filed by the 4th respondent, paragraph 7 of which reads as under:

" It is submitted that based on the investigation and as per the statements of the witnesses, it is revealed that the alleged Accused 3 to 5 have not committed the offence, hence, obtained permission from the Superintendent of Police for deletion of their names vide Memo C.No. 68/D4/DCRB./2017, dated 19.06.2017. The investigation also not established offence under Sections 307, 324 against Accused Nos. 1 and

2. It is submitted that notices under Section 41(A) Cr.P.C. were served to A1 and A2 on 20.06.2017. It is submitted that the Police Station has yet received M.C. from the Hospital. It is submitted that after receipt of M.C., Korutla Police will file the charge sheet against Accused No.1 and 2 u/s 336, 338, 290 read with 109 IPC before the concerned Court." In the light of the action taken by the 4th respondent, the grievance of the petitioner stands redressed. Accordingly, the Writ Petition is closed. However, it is open to the petitioner to avail the remedies in accordance with law with respect to the averments in the counter filed by the 4th respondent. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
