HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.1276 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties.

The petitioners are residents of Musalreddygaripalli, hamlet of Thallapalli Village, Vempalli Mandal, Y.S.R. District. They were issued white ration cards attached to fair price shop No.16, Thallapalli Village, Vempalli Mandal, Y.S.R. District which is at a distance of 3 K.Ms. away from the village. There were nearly 120 ration card-holders and they had to go to Thallapalli Village to receive essential commodities twice in a month. In order to go to Thallapalli Village, they have to cross Pulivendla - Kadapa Highway which is risky. In those circumstances, they submitted a complaint in 'Praja Vani' conducted by the District Collector, YSR District, on 21.07.2014, which was referred to respondent Nos.2 to 4. In response to the same, the fourth respondent submitted a report to the third respondent. Based on which, the third respondent recommended to the second respondent for establishment of a new fair price shop with 120 card-holders at Thallapalli Village, Vempalli Mandal, Y.S.R. District. When no action was taken by the second respondent, the present Writ Petition is filed.

Learned Government pleader took notice on 28.01.2015 and no counter affidavit is filed till today.

In view of the facts and circumstances of the case, this Court is inclined to dispose of the Writ Petition at the admission stage directing the second respondent to consider the letter dated 03.09.2014, submitted by the third respondent, and pass appropriate orders thereon, within a period of three months from the date of receipt of a copy of the order. The Writ Petition is, accordingly, disposed of.

As a sequel thereto, miscellaneous applications, if any, also stand disposed of. No order as to costs.
