THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION NO. 24996 of 2017 ORDER :

Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage. 2.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in interfering with the personal life and liberty of the petitioner by calling him to the police station under the guise of investigation, without there being any crime registered against him, as illegal and arbitrary. 3.

The grievance of the petitioner is that there were some matrimonial disputes between the petitioner and unofficial respondent and accordingly, at the instance of unofficial respondent, the petitioner is being insisted by the respondent police to settle the disputes, failing which the respondent police threatened him with dire consequences. Hence the present writ petition.

Though various grounds are raised, learned counsel for the petitioners mainly submits that the respondent police may be directed not to interfere with the marital disputes between the parties and not to call the petitioner to the police station, without following due process of law.

Learned Government Pleader, while denying the allegations made in the writ affidavit, submits that any action taken against the parties shall be in accordance with law.

Without going into merits of the case and having regard to the submissions made, the Writ Petition is disposed of directing the respondent police not to interfere with the personal life and liberty of the petitioner or any matrimonial disputes pending between the parties and not to call the petitioner to the police station, without following due process of law. However, if the respondent police intend to take any action against the parties and if any crime is registered against the parties, the respondent police shall take steps in accordance with law. No costs.

Consequently, miscellaneous petitions, if any pending, shall stand closed.
