THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.S.K.JAISWAL WRIT PETITION No.14389 OF 2015 ORDER:- (per Hon'ble Sri Justice K.C.Bhanu) This writ petition is filed challenging the interim order, dated 1.5.2015, in O.A.No.2171 of 2015 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad (for short, "the Tribunal").

2. Petitioner herein/applicant filed the aforementioned Original Application before the Tribunal to declare the proceedings, dated 6.4.2015, of respondent No.2 in placing him under suspension as illegal and arbitrary and consequently, to set aside the same.

3. The Tribunal, upon considering the material on record, while admitting the aforementioned Original Application, directed to issue notice to the respondents returnable in four weeks. As the allegations against the petitioner are grave in nature, the Tribunal declined to grant any interim order. Hence, the applicant filed the present writ petition.

4. Heard.

5. Suspension pending enquiry cannot be interfered with unless the suspension is illegal. There is a prima facie case to show that the petitioner has not discharged his duties in accordance with law. Therefore, the impugned order needs no interference by this Court and the writ petition is liable to be dismissed.

6. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
