HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.2158 of 2017 ORDER :

This criminal petition is filed to relax the condition imposed by the II-Additional Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.2323 of 2015 in Crime No.HQPOR No.22 of 2015 - ST AE - VII, Service Tax Commissionerate Hyderabad, dated 03.08.2015, and this Court in Crl.P.No.8337 of 2016 dated 14.06.2016, Crl.P.No.14910 of 2016 dated 17.10.2016, Crl.P.No.751 of 2017 dated 01.02.2017.

In pursuance of the order in Crl.M.P.No.2323 of 2015, the passport was deposited with the learned XII-Additional Chief Metropolitan Magistrate, Hyderabad.

Sri B.Narasimha Sarma, learned Special Public Prosecutor for CBEC, fairly conceded that they have no objection to release the passport subject to cooperation with the Commissioner of Service Tax, as only adjudication is pending. Attention of this Court is also drawn to the letter dated 22.09.2016 addressed to the learned Special Public Prosecutor by the Commissioner, expressing no objection for return of passport bearing No.N2613890, as only adjudication is pending, which can be completed without the presence of the petitioner.

This Court also passed order in Crl.P.No.14910 of 2016 dated 17.10.2016 directing the Court below to return the passport.

In view of the no objection reported by the learned Special Public Prosecutor, the Criminal Petition is disposed of directing the XII-Additional Chief Metropolitan Magistrate, Hyderabad, to release the passport bearing No.N2613890 to the petitioner under proper acknowledgment.
