M/S.Sree Durga Bhavan, v. State Of Telangana Department Of Revenue
HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY W.P.No.36415 of 2014 and W.P.No.38489 of 2015 COMMON ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) Both Sri Vedula Srinivas, Learned Counsel for the petitioners, and Sri K.Vivek Reddy, Learned Special Counsel appearing for the respondents, would agree that the subject matter of these Writ Petitions are covered by the common judgment of this Court in W.A.No.259 of 2015 and batch dated 16.11.2016.
Sri Vedula Srinivas, Learned Counsel for the petitioners, would submit that, unlike in the aforesaid batch of Writ Appeals, the enhanced compensation under the 2013 Act, in these two Writ Petitions, has been deposited in the Court; and the petitioners be permitted to withdraw the deposited amount.
In the batch of Writ Appeals referred to hereinabove, the respondents were directed to pay compensation under the 2013 Act, in all such cases where possession of land was taken, within four months from the date of the order (i.e from 16.11.2016). As, in the present Writ Petitions, the enhanced compensation amount has been deposited in the Court, we consider it appropriate to permit the petitioners to withdraw the said amount after four months from today.
Both these Writ Petitions are also disposed of in accordance with, and in terms of, the common judgment passed in W.A.No.259 of 2015 and batch dated 16.11.2016. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs. ________________________________ RAMESH RANGANATHAN, ACJ ___________________________________ M. SATYANARAYANA MURTHY, J Date:17.11.2015.
