THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.32350 of 2012 ORDER:

The wife and husband, who claimed to have purchased the land to an extent of Ac.4.60 cents in Survey No.125 situated at Chanugondla Village, Owk Mandal, Kurnool District, filed the present writ petition seeking a direction to respondents 1 and 2 to provide police protection so as to enable them to carry out the agricultural operations in their land.

This writ petition was filed in the year 2012 and no interim order was passed.

Learned counsel for the petitioners brought to the notice of this Court that on an earlier occasion, by order dated 03.12.2007 in W.P.M.P.No.33328 of 2007 in W.P. No.25584 of 2007 when the police were interfering in a civil dispute, despite the order of injunction granted in I.A. No.346 of 2005 in O.S.No.138 of 2005, this Court directed the police not to interfere with the civil disputes in regard to the land. Strangely the present writ petition is filed seeking police protection.

This Court is not inclined to grant such relief as O.S.No.138 of 2005 is pending on the file of the Junior Civil Judge, Banaganapalli, which is a civil dispute between the petitioners and the respondents 3 and 4. However, it is open to the petitioners to take appropriate steps in the pending suit for appropriate remedy to protect their land. With the above observations, this Writ Petition is disposed of. No order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
