THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26700 of 2017 ORDER:

This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in not considering the representation dated 05.08.2017, accepting the typographical error occurred in Bank Guarantee for EMD submitted in relation to the tender notification vide No.109/DB/D4/SDPT/Shift-600dia BWSC/2017, Dt:

12.06.2017, as illegal, arbitrary, unconstitutional and consequently direct respondent No.3 to declare the petitioner as L1 being a preferred bidder."

When the matter is called, it is submitted by the learned counsel for the petitioner that for redressal of its grievance, the petitioner submitted a representation, dated 05.08.2017 to respondent No.3 but no action has been taken on the said representation. A request is made by the learned counsel for the petitioner to direct respondent No.3 to take action on the said representation in accordance with law.

Having regard to the said submissions, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of, directing respondent No.3 to take action on the

AVSS, J W.P.No.26700 of 2017 representation, dated 05.08.2017 said to have been submitted by the petitioner, in accordance with law.
