HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6161 of 2015 ORDER:

This petition is filed by the petitioner-accused No.2 under Section 438 Cr.P.C. seeking bail in C.C.No.96 of 2011 on the file of the Judicial First Class Magistrate at Narayanpet, Mahabubnagar District.

The petitioner is alleged to have committed offence punishable under Sections 379 IPC and Sections 21(1) r/w 6 of A.P. Mines and Minerals (Regulation and Development) Act, 1957 and under Section 25/35 (1) of WALTA Act.

The case of the petitioner is that on coming to know about the registration of the case, he surrendered before the Court and later, he was enlarged on bail.

It is stated that the petitioner filed Crl.P.No.11988 of 2011 seeking to quash the proceedings in the above C.C. and while admitting the above Criminal Petition, this Court granted interim stay of all further proceedings in the above C.C. including the appearance of the petitioner. While so, the Narayanpet police called upon the petitioner stating that NBWs are pending against him in the above C.C. Hence, the petitioner filed this petition. Considering the facts and circumstances of the case, the petitioner is directed to surrender before the learned Magistrate and file an application for recalling NBWs issued against him. On such application being filed, the learned Magistrate is directed to recall NBWs issued against the petitioner. Further, the learned Magistrate is directed not to insist for appearance of the petitioner till disposal of Crl.P.No.11988 of 2011.
