THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2544 OF 2016 ORDER:

Heard learned counsel for the petitioner and Sri P. Bhaskar Reddy, learned Standing Counsel for the 1st respondent. The petitioner seeks to enforce a direction against the 1st respondent, who is bound to execute the orders of the Executing Court for attachment of his salary already passed against him. On the other hand, when the 1st respondent is complying with the orders of the Executing Court, a direction in a Writ Petition cannot be granted as sought for by the petitioner. It is however open to the petitioner to approach the Executing Court for modification of the attachment order in accordance with law.

The Writ Petition is accordingly disposed of giving liberty to the petitioner to approach the Executing Court for modification of the attachment order in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
