HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18582 of 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed for the following relief:

"to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the 3rd respondent in disposing petitioner's appeal vide Appeal No.3544/2014 (which was submitted in Prajavani) for rectification of revenue records pertaining to Sy No.210/1A and 210/2A to an extent of Ac.6.17 of land situated at Kurumidda Shivar, Kalwakurthy Mandal, Mahaboob Nagar District as illegal arbitrary."

2. The case of the petitioner is that he is the absolute owner and possessor of aforesaid property. He acquired the aforesaid property by way of inheritance and his name was also recorded in the revenue records. Thereafter, the petitioner sold some extent of land to the 6th respondent. While things stood thus, the revenue authorities illegally recorded the petitioner's entire land situated in the above two survey numbers in the name of the 6th respondent, though the petitioner sold some extent of land to her. In pursuance of the same, the petitioner made an application to the 2nd respondent, who in turn forwarded the same to the 4th respondent. Thereafter, the 4th respondent allotted a case No.3455/2014, dated 09.06.2014 and issued notice on 10.09.2014 for conducting enquiry. But, till today no enquiry is conducted and no action has been taken.

3. Heard both sides.

5. Considering the facts and circumstances of the case, the Writ Petition is disposed of directing the 4th respondent to complete the enquiry in pursuance of notice, dated 10.09.2014, and pass appropriate orders in accordance with law within a period of four (4)

weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
