HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4550 of 2015 ORDER:

This criminal petition is filed by the petitioner seeking to enlarge him on bail in the event of his arrest in connection with Crime No.121 of 2015 on the file of Police Station, Chaitanyapuri, Cyberabad, registered for the offences under Sections 417, 363, 384, 376 IPC.

Heard the learned counsel for the petitioner and learned Public Prosecutor. The facts of the case are as follows. A.1, who is not the petitioner herein, along with A.2, the petitioner herein, and A.3, the driver of the vehicle, kidnapped the victim girl and they traveled from the place of kidnap to various places like Nagpur, Jhansi and New Delhi. After fifteen days, A.1 and A.2, the petitioner herein, left the victim girl at Warangal and thereafter she went to the police station and lodged the complaint. On the date of missing of the victim girl, her brother also lodged a complaint that his sister, the victim girl, was missing from the house. The allegation against the petitioner herein, A.2, is that he followed A.1 all the way from Hyderabad from the time of kidnapping the victim girl and as such, A.2 abated A.

1 in committing rape by taking her to different places. It clearly shows that there is no allegation of any sexual harassment against the petitioner herein. The only allegation leveled against the petitioner/A.2 is that he actively assisted A.1 in kidnapping the victim girl. The person, who actively participated in the crime, i.e., A.1., was already arrested and was remanded to judicial custody. Insofar as the present petitioner, A.2, is concerned, considering the circumstances of the case, this Court is inclined to grant anticipatory bail and the same would not cause any prejudice to the prosecution. The criminal petition is allowed and the petitioner/A.2 shall be released on bail in the event of his arrest, on his executing a personal bond for a sum of Rs.

10,000/- (Rupees ten thousand only) with two sureties each in a likesum to the satisfaction of Station House Officer, Chaitanyapuri Police Station, Cyberabad, and on further condition of the petitioner reporting before the Station House Officer daily until further orders.
