HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.3394 of 2011 ORAL ORDER:

Petitioner filed this writ petition praying to grant the following relief. '.....to issue a Writ order or direction more in the nature of Writ of Mandamus to appoint as Conductor under B.C(E) quota as pet the marks secured pursuant to the above Notification NO.

E1/684(2)/2010/RK/Kurnool dt. 31-7-2010 in any one of the Vacancies notified 219 Conductor posts with all consequential benefits by holding the action of the respondents not filling all the notified Vacancies as per the notification and appointment under B.C. (E) quota as per Marks Secured by the petitioner is as illegal, arbitrary, discriminatory, unjust and violative of Articles 14, 16 and 21 of the Constitution of India and pass other orders...."

2. None appeared for the petitioner.

Learned standing counsel for respondent corporation, on instructions, submits that petitioner was appointed in the year 2012 and presently working as Conductor in Koilakuntla depot of the respondent corporation. Probably, this may be the reason, petitioner is not prosecuting the writ petition. In view of the stand of the respondent, cause in the writ petition does not survive and accordingly, writ petition is dismissed as infructuous. No costs.

4. Having regard to the same, miscellaneous petitions, if any pending, are closed.
