This writ petition is filed challenging the proceedings in Rc.No.685/2015/HR-H, dated 25-05-2017 issued by the 2nd respondent, wherein the petitioner was suspended pending enquiry on the allegation that he is not attending duties.

Learned counsel for the petitioner says that without any notice the impugned order has been passed. On the other hand, learned Standing Counsel for respondent No.2 produced notice dated 19-07-2017 stating that the petitioner was issued notice for initiating disciplinary proceedings. But the learned counsel for the petitioner disputes service of the said notice, dated 19-07-2017.

It is to be seen that for suspension pending enquiry, no notice is required. Since already charge memo issued to the petitioner on 19-07-2017 and a copy of the same is produced by learned Standing Counsel and served on the petitioner's counsel, it is open for the petitioner to submit explanation within a period of two weeks from the date of receipt of a copy of this order and thereafter, it is open for the 2nd respondent to pass appropriate orders in

accordance with law within a period of four weeks thereafter.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 08-08-2017 Nvl
