HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Petition Nos.35600 and 35619 of 2016 Common Order: (per V.Ramasubramanian, J.) Aggrieved by a seniority list dated 18-8-2014 and the alleged failure of the respondents to dispose of appeals against the said seniority list, the writ petitioners filed applications in O.A.Nos.3491 and 3492 of 2016 on the file of the Andhra Pradesh Administrative Tribunal, at Hyderabad. On the ground that the appeal is still pending, the Tribunal disposed of the original applications directing the respondents to dispose of the appeal within 3 months.

2. Aggrieved by the said order, the petitioners have come up with the present writ petitions.

3. Heard Mr. K.Ram Reddy, learned counsel for the petitioners and the learned Government Pleader for Services I (Andhra Pradesh) for the respondents 1 to 3.

4. On instructions, the learned Government Pleader submitted that as against the seniority list dated 18-8-2014, the petitioners filed an appeal on 12-12-2014 and that the same was disposed of by order dated 04-3-2016.

5. But according to the learned counsel for the petitioners, the order dated 14-3-2016 deals only with one facet of the grievance and that it does not deal with the objections to the seniority list at all.

6. Irrespective of whether the objections of the petitioners were fully considered or not, the stand of the respondents is that the appeal filed by the petitioners stand disposed of. If that is so, the correctness of the order passed in the appeal will have to be agitated by the petitioners only before the Tribunal, since the Tribunal did not go into the merits of the case.

7. Therefore, the writ petitions are disposed of permitting the petitioners to move the Tribunal as against the order dated 14-3-2016, taking note of the stand taken by the Government to the effect that the statutory appeal against the seniority list stand disposed of by the order dated 14-3-2016. The miscellaneous petitions, if any, pending in these writ petitions shall stand closed. No costs.
