Shaik Ameena Bee , Ameena Bude v. Shaik Ajimuneesa
THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY CIVIL REVISION PETITION NO.5021 OF 2015 DATED:04-12-2015 Between:
Shaik Ameena ... Petitioner And Shaik Ajimuneesa ... Respondent COUNSEL FOR THE PETITIONER: Mr. Srinivasa Rao Velivela, for Mr. Kambhampati Ramesh Babu COUNSEL FOR THE RESPONDENT: - THE COURT MADE THE FOLLOWING:
ORDER:
This civil revision petition arises out of order dt.26.10.2015 in I.A. No.1370 of 2015 in O.S. No.193 of 2011, on the file of the Principal Junior Civil Judge, Sattenapalli, Guntur District. The respondent filed the above mentioned suit for perpetual injunction against the petitioner in respect of the suit schedule property. During the trial, the petitioner has examined herself as D.W.1 and has also examined D.Ws.2 and 3 on 1.6.2015. As the petitioner did not report further evidence, the evidence on her side was closed and the case was posted for arguments. At this stage, the petitioner has filed the above mentioned I.A. for reopening the evidence on her side. This application was dismissed by the lower Court. It is not in dispute that the petitioner has not indicated the purpose of summoning the Tahsildar. The very fact that the petitioner could not file any application for summoning the Tahsildar before her evidence was closed itself shows that she was not diligent in pursuing her case. Therefore, I do not find any reason to interfere with the order of the lower Court.
The civil revision petition is accordingly dismissed. As a sequel to dismissal of the civil revision petition, C.R.P.M.P. No.6611 of 2015 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 04-12-2015 bnr
