THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6907 OF 2010 ORDER:

This writ petition is filed challenging the award dated 31.01.2008 passed in ID.No.79/2005 by the Presiding Officer, Labour Court II, Hyderabad, wherein relief was granted in favour of 1st respondent herein.

When the writ petition came up for hearing on 04.11.2013, this Court passed the following order;

"Learned counsel for the petitioner/s shall take out personal notice to respondent No.1 by registered post with acknowledgment due within a period of four weeks from today, failing which the writ petition against respondent No.1 shall stand dismissed."

For non compliance of the aforesaid order, the writ petition against 1st respondent was dismissed for default as proof of service of notice is not filed within the time stipulated. Unless 1st respondent is a party, no relief can be granted to the petitioner. Accordingly, the writ petition is dismissed. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
