THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15623 of 2017 ORDER:

This Writ Petition is filed challenging registration of Crime No.45 of 2017 by the second respondent pursuant to the complaint lodged by the third respondent.

This Court carefully perused the complaint of the third respondent and it discloses a prima facie case for registration of the crime. In view of the same, this Court is not inclined to interfere with the registration of the crime. However, the second respondent can go ahead with the investigation, but shall follow due process of law, including compliance with Section 41-A of Cr.P.C.
