THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 9124 of 2015 O R D E R:

The petitioner herein sought for a writ of mandamus for declaring the inaction on the part of the respondents in considering his representation seeking reinstatement into service, as illegal.

Heard learned counsel for the petitioner and Sri Bathula Raj Kiran, learned Standing Counsel, who accepted notice on behalf of the respondents. It appears, the petitioner was initially engaged as an Assistant Trainee with the Life Insurance Corporation of India (LIC) on 06.12.1989 and he was also confirmed in the said post on 06.06.1990. He was subsequently, promoted as a Cashier and was posted as a Higher Grade Assistant. However, he went missing without leaving any information either at his office or with his family members. It appears, he functioned as an Agent of the LIC of its Panvel Branch in Mumbai, but however, after coming to know that the Corporation has removed his services for his continuous unauthorized absence, he appears to have submitted a representation on 08.01.2013, followed it up with another one on 04.03.2013.

It is his case and claim that these representations have not been considered. Hence, this Writ Petition. Since no useful purpose would be served by keeping this writ petition pending and confining it to the docket of this Court, the ends of justice would be adequately served if the respondents are directed to consider the representation, dated 04.03.2013, if the same was received by them, and pass appropriate orders thereon, in accordance with law, as expeditiously as is possible, preferably within a maximum period of two months from the date of receipt of a copy of this order. With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous petitions, if any, shall also stand disposed of.
