Heard Mr.G.Tuhin Kumar, counsel for the petitioners and the Assistant Government Pleader for respondents 1 to 3, 5 and 6. The petitioners, aggrieved by the order of 4th respondent dated 6-9-2016, have filed appeal before the second respondent. The petitioners along with appeal filed petition praying for grant of stay against the order dated 6-9-2016. The appeal filed by the petitioners has been taken on file as appeal No.2(1)/24/2017. The grievance of petitioners is that with enormous delay, appeal was filed. The appellate authority has set aside the order dated 8-6-2011 in AIP 78 of 2011, In view of developments in the matter during the pendency of appeal, the request for stay if is not considered and appropriate orders are passed, the petitioners are put to great injustice and hardship. Hence, prayed for a direction to dispose of stay petition filed along with the appeal No.2(1)/24/2017.
I have perused the material available on record. Prima facie, I am satisfied that the second respondent ought to have considered the request of petitioners for grant of stay and pass orders as is warranted in the circumstances. Hence, the second respondent is directed to pass orders on the stay petition filed by the petitioners herein within two weeks from the date of receipt of copy of this order.
The petitioners are given liberty to file the copy of order along with memo and seek a date to dispose of the stay petition. The Writ Petition is disposed of accordingly. No order as to costs.
