THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.118 OF 2017 ORDER:

This writ petition is filed challenging the registration of F.I.R.No.345 of 2016, dated 11-11-2016 on the complaint lodged by the 3rd respondent.

2. 3rd respondent filed a complaint before the II Additional Judl. Magistrate of I Class, Ongole. On reference by the learned Magistrate, a crime was registered. The concerned Magistrate has applied his mind and asked the police to investigate into the matter. This Court in exercise of jurisdiction under Article 226 of the Constitution of India cannot quash the crime since it is open to the petitioner to take appropriate steps in accordance with law before the concerned Magistrate. 3.

A reading of the complaint makes it clear that the allegations made in the complaint have to be investigated into by the concerned police. Therefore, this Court does not find any ground to interfere with the registration of crime on the basis of the complaint lodged by the 3rd respondent. However, the police are directed to investigate into the crime in accordance with law by duly complying with the provisions of Code of Criminal Procedure, 1973.

Accordingly, the writ petition is disposed of No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
