HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9132 of 2017 ORDER:

This Criminal Petition is filed to quash the proceedings in C.C.No.422 of 2016 (Old C.C.No.37 of 2012) on the file of the learned Judicial First Class Magistrate, Nidamanoor. Learned counsel for the petitioner-accused No.2 seeks permission of the Court to withdraw the Criminal Petition with liberty to the petitioner to file an application before the trial Court seeking appropriate relief such as recalling of nonbailable warrant issued against the petitioner, etc. The Criminal Petition is, accordingly, dismissed as withdrawn, granting liberty to the petitioner as prayed for. As a sequel, the Miscellaneous Petitions, if any, shall stand dismissed.
