HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.12783 OF 2017 ORDER:

The grievance of the petitioner is that the Government issued G.O.Ms.No.59, dated 30-12-2015 for regularization of lands to the extent of construction made in the subject land, but respondent No.6 has regularized subject land in favour of unofficial respondents 5 to 7 in violation of said G.O. by regularizing entire extent claimed by them, though G.O. states that regularization only to the extent of constructions made in the subject land. As such, the petitioner made representation to the respondents 1 to 4. Aggrieved by the inaction of the respondents 1 to 4, the present writ petition is filed. Heard Sri Vedula Srinivas, learned counsel for the petitioner.

Learned Assistant Government Pleader for Revenue says that the petitioner has to approach grievance redressal authority as per para No.2 of clause- xiv of G.O.Ms.No.59, dated 30-12-2015, which reads as follows:

" The Joint Collector concerned will be the Grievance Redressal Authority in the matter if any and he may give directions to the committee as he deems fit." A reading of above clause indicates that during the course of considering the applications, the Joint Collector issues directions to the committee. It also provides that the Joint Collector is the grievance redressal authority in the matters of regularizations also. More so, the Revenue Divisional

Officer and Tahsildar, who are constituting the committee for regularization applications. As the Joint Collector is the grievance redressal authority, it is open to the petitioner to make application to the concerned Joint Collector in terms of G.O.Ms.No.59, dated 30-12-2014 and on such application, the Joint Collector shall consider and dispose of the same after issuing notice to the affected parties and pass orders. With the above direction, this writ petition is disposed of.
