HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 4 0 5 0 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Mills Colony Police Station, Warangal District, dated 16.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is respectfully submitted that as per the records, the facts of the case are that the petitioner herein has scant respect towards law and was involved in the following criminal cases.

1) Cr.No.172/ 2011, u/ secs.120(B), 199, 499, 417, 420 I.P.C., and Section 153 (2) Cr.P.C. on the file of Mills Colony Police Station........." (Case is pending trial vide C.C.No.36/ 2018)

2) Cr.No.77/ 2012 u/ s.307 r/ w 34 I.P.C., of PS.Mills Colony.

(Case is pending trial vide S.C.No.563/ 2012)

3) Cr.No.139/ 2015 u/ ss.353, 342, 186, 448 r/ w 34 I.P.C., of P.S.Mills Colony.

(Case is ended in acquittal)

4) Cr.No.227/ 2015 u/ ss.447, 427, 506 of I.P.C., of Mills Colony P.S.

(Case is pending trial vide C.C.No.441/ 2015)

5) Cr.No.96/ 2018 u/ ss.420, 506 r/ w 34 I.P.C., of P.S.Mills Colony.

(In view of the interim stay orders granted by the Hon'ble Court, the investigation was stopped)

6) Cr.No.375/ 2018 u/ s.110 Cr.P.C. (bind over), dated 15.10.2018 of P.S.Mills Colony.

Due to the involvement of the criminal cases and to curb and curtail the unlawful activities of the petitioner herein in the vicinity of Mills Colony Police Station, Wrangal District, after obtaining permission from the authorities, rowdy sheet has been opened against the petitioner herein on 29.06.2015 and it is

being continued and renewed from time to time on the rolls of Mills Colony Police Station and it stands extended up to 31.12.2018.

It is respectfully submitted that at present the petitioner is facing trial in cases i.e., 1) Cr.No.227/ 5015;

2) Cr.No.172/ 2011 and 3) Cr.No.77/ 2012; and 4) Cr.No.96/ 2018 (due to the interim stay orders of this Hon'ble Court, the investigation was stopped tentatively) and 5) Cr.No.375/ 2018 u/ s.110 Cr.P.C. (bind over case to keep good behaviour).

I humbly submit that due to fear of the petitioner/ accused, no one has come forward to the Police Station to lodge any fresh complaints against him.

It is submitted that the allegation of the petitioner that this respondent Police are coming to his residence and knocked the doors during the odd hours to know the whereabouts of him is absolutely false and hence denied."

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Mills Colony Police Station, Warangal District, dated 16.11.2018, with a further direction to the respondent-Police authorities not to interfere with the personal liberty of the petitioner herein except in accordance with law.
