THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 38111 of 2014 ORDER: (Per the Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed for a Habeas Corpus to produce the alleged detenu, Jangala Swarup Kumar.

A counter affidavit was filed by the Inspector of Police, Guntur Taluk (Nallapadu) Police Station, Guntur, stating that the alleged detenu was arrested in connection with Crime No.58 of 2014 on the file of the T. Sodayapalem Police Station and that he was produced before the Additional Junior Civil Judge, Repalle, on 15.12.2014 and was remanded to judicial custody. It was further stated that he is presently lodged at Sub-Jail, Repalle, Guntur District.

Though time was sought by the learned counsel for the petitioner on 18.12.2014 to file a reply to the counter affidavit, no steps have been taken till date. However, a request is made for grant of further time. As the matter relates to Habeas Corpus and as the alleged detenu is not subjected to any wrongful or illegal confinement as he has been remanded to judicial custody, this Court is not inclined to entertain and interfere in this matter. It is for the petitioner to take necessary steps in accordance with law consequent upon the developments aforestated.

The writ petition is accordingly dismissed with the liberty

aforestated. No order as to costs.
